ArcaBit Sp. z o.o. company, hereinafter called the Manufacturer, shall have the exclusive right to distribute the ArcaVir antivirus program for the following systems: Linux, FreeBSD, NetBSD, OpenBSD, Solaris. It shall be protected under the Polish law (the Act on Intellectual Property Rights and Related Rights, the journal of laws No. 24, item 83), as well as international regulations on the protection of intellectual and legal property.

The free-of-charge license shall entail the right to install and use arcavir or arcavir and arcavird programs (under the following operating systems Linux, FreeBSD, NetBSD, OpenBSD, Solaris) on any number of computers after the below conditions have been fulfilled:

1. A report containing the names of viruses detected with he help of the program is sent regularly at least once a month to the address: report_linux@arcabit.com. The report shall be in form of a text file, containing at least the name of a virus (worm, Trojan). Reports may be sent more often (once a week, daily) and may be compressed (gzip or bzip2).
   
2. An advertisement of ArcaVir program is presented on Web sites or in electronic messages (one out of the two) along with the information on the use of arcavir program and link to the Manufacturer’s Web site. Should those conditions be impossible to fulfill, please contact our sales department: office@arcabit.com and linux@arcabit.com.

The program with the free-of-charge license can be added at no cost to CD-ROMs attached to magazines and Linux distribution or mirrored on Web or ftp servers. It should be the exact copy located on the Manufacturer’s Web site (i.e. parts of files must not be removed from .tar .tgz or .bz2). Files can be recompressed to the RPM format or another distribution of Linux or *BSD.

The holder of the free-of-charge license shall have no right to

1. make copies of the Program, beside one copy for archiving purposes;
2. modify, translate, recompile the Program and the accompanying documentation in any form;
3. make attempts to reproduce the source code of the Program;
4. create related products on the basis of the Program;
5. remove or modify trade marks and information on the product presented in the Program or in the attached materials;
6. scan with the help of that version computers with shared drives on which in course of operation MS © Windows system is active. To control Windows systems resources ArcaVir for Windows program should be used.

The Manufacturer warrants that the arcavir program shall to a major extent work in accordance with the enclosed documentation and that CD-ROMs shall be free from defects in materials. The Manufacturer does not warrant that the Program shall fulfill the Purchaser’s expectations. The Program is subject to complex tests within the scope of the correct functioning and interaction with various software, but, nevertheless the Manufacturer does not warrant the complete faultlessness of the Program and perfect interactions with other software. The Manufacturer shall not be held responsible for damages resulting from the use of the Program or the lack of possibility of using the Program, irrespective of the fact under what circumstances those damages occurred and what they relate to. The Purchaser shall bear the full risk related to the possibility of using the Program for a specific goal.

Damage liability waiver

The Manufacturer shall not be held liable for any accidental, non-accidental, indirect or related damages, including the loss of opportunities or data, that occurred as a result of the use of the Program, even if the Manufacturer has been notified of the possibility of occurrence of such damages. Waivers and restrictions presented above shall be applied irrespective of the fact, whether the Purchaser accepts the Program.
